Terms of Service

This is a reasonable draft written to cover the basics for an early-stage subscription app — it is not a substitute for review by a licensed attorney. Have a lawyer review and adapt this (especially the liability, arbitration, and governing-law sections) before a wide public launch.

1. Acceptance of these Terms

By creating an account or using PEAK (“PEAK,” “we,” “us”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. We may update these terms from time to time; continued use after a change means you accept the updated terms.

2. What PEAK Is

PEAK is a software application that uses an AI system to generate personalized triathlon training plans, strength programming, and race-day nutrition guidance based on information you provide, and to answer training-related questions in a chat interface. Plans, workouts, macro targets, and coaching responses are generated automatically and are not reviewed by a human coach, dietitian, or medical professional before being shown to you.

3. Not Medical, Nutritional, or Professional Advice

PEAK is not a medical provider, registered dietitian, certified personal trainer, or licensed professional of any kind, and nothing in the app constitutes medical, nutritional, psychological, or professional advice. Training plans, calorie and macronutrient targets, exercise prescriptions, and race-day fueling guidance are generated by an AI system and are provided for informational and educational purposes only.

Endurance and strength training carry inherent risks, including but not limited to injury, cardiac events, dehydration, and overtraining. Before starting this or any training program, and periodically while using it, you should consult a physician — particularly if you have any pre-existing medical condition, injury, are pregnant, or are over 40 and have not recently exercised.

AI-generated content can be wrong, out of date, or inappropriate for your specific situation. You are responsible for using your own judgment, stopping any workout or nutrition guidance that doesn’t feel right, and seeking qualified professional care (a physician, physical therapist, or registered dietitian) for anything beyond general fitness guidance.

4. Assumption of Risk

You voluntarily choose to follow any training plan, workout, or nutrition guidance PEAK provides, and you assume all risk of injury, illness, or other harm that may result. To the fullest extent permitted by law, PEAK and its operators are not liable for injuries or damages arising from your use of, or reliance on, content generated by the app. This does not limit liability where such limitation is not permitted by law.

5. Eligibility and Accounts

You must be at least 18 years old to create a PEAK account. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us promptly if you suspect unauthorized access.

6. Subscription, Billing & Free Access

Week 1 of your training plan is available free to all users. Full access to your complete multi-week plan requires a paid subscription, currently offered monthly ($14/month) or annually ($129/year); pricing is displayed in the app and may change with notice.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel anytime from the Settings page; cancellation stops future billing but does not retroactively refund the current billing period. Access to paid features continues until the end of the period you’ve already paid for.

Refunds: Payments are generally non-refundable, including for partial billing periods or unused time. If you believe you were charged in error, contact us within 14 days of the charge and we’ll review it in good faith on a case-by-case basis.

A limited number of early users may be offered free lifetime access as a founding member in exchange for product feedback. That access is granted at our discretion and is not transferable.

7. Acceptable Use

PEAK is for your own personal, non-commercial use. You agree not to: share your account with others or resell access; attempt to reverse-engineer, scrape, or extract the underlying AI models or training data; use the service to generate content for anyone other than yourself without our permission; or interfere with the normal operation of the service.

8. Your Content

You retain ownership of the information you provide (profile details, session logs, chat messages). By using PEAK, you grant us a license to use that information to operate the service — generating and adapting your plan, powering coaching chat, and improving the product. 9. Account Deletion

You may permanently delete your account and all associated data at any time from Settings → Danger Zone. Deletion removes your profile, training plans, session logs, chat history, and push notification subscriptions, and cannot be undone. Deleting your account does not automatically cancel an active paid subscription — cancel your subscription separately first if you don’t want to be billed again.

10. Disclaimer of Warranties

PEAK is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, or non-infringement. We do not guarantee the service will be uninterrupted, error-free, or that AI-generated plans or coaching responses will be accurate, complete, or suitable for your circumstances.

11. Limitation of Liability

To the fullest extent permitted by law, PEAK and its operators will not be liable for any indirect, incidental, special, or consequential damages, or for any personal injury, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose.

12. Termination

We may suspend or terminate your access if you violate these terms or misuse the service. You may stop using PEAK and delete your account at any time.

13. Changes to the Service

PEAK is an early-stage product and features, pricing, and functionality may change as we develop it. We’ll do our best to communicate material changes in advance.

14. Governing Law
